Terms of Service

1. Acceptance of Terms

By accessing or using Bowser (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service. These Terms constitute a legally binding agreement between you and MJS Consulting ("we", "us", "our"), the operator of Bowser.

2. Description of Service

Bowser is an Australian fuel price comparison application that displays fuel prices sourced from government APIs (including Queensland, New South Wales and Tasmania) as well as community-reported prices. The Service allows you to:

  • Search for fuel stations and compare prices in your area.
  • Find the cheapest fuel along a driving route between two locations.
  • View price history and trends for fuel stations.
  • Submit fuel price reports and reviews for fuel stations.
  • Set up price alerts for stations and fuel types you care about.

We may modify, suspend or discontinue any part of the Service at any time without prior notice.

3. Your Account

You may create an account through our authentication provider, Clerk. When you create an account, you agree to provide accurate and complete information. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately if you become aware of any unauthorised use of your account.

Some features of Bowser are available without an account. Creating an account enables additional features such as saving stations, setting price alerts and submitting reviews.

4. Acceptable Use

When using Bowser, you agree not to:

  • Submit false, misleading or fabricated fuel prices or station reviews.
  • Use automated tools, bots or scrapers to access, extract or collect data from the Service.
  • Attempt to gain unauthorised access to any part of the Service, its servers or any connected systems.
  • Interfere with or disrupt the operation of the Service or the experience of other users.
  • Use the Service for any unlawful purpose or in violation of any applicable Australian law or regulation.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Reverse engineer, decompile or otherwise attempt to extract the source code of the Service.

5. Price Data

Fuel prices displayed in Bowser are sourced from Australian government fuel price APIs and from community submissions. While we make every effort to display accurate and up-to-date pricing information, we do not guarantee the accuracy, completeness or timeliness of any price data shown.

Prices may change between the time they are reported and the time you arrive at a station. You should always verify the price at the pump before fuelling. Bowser is an informational tool and should not be relied upon as the sole basis for any fuel purchasing decision.

6. Intellectual Property

The Bowser name, logo, design, features, code and all related intellectual property are owned by MJS Consulting and are protected by Australian and international intellectual property laws. You may not copy, modify, distribute or create derivative works based on the Service or any of its content without our prior written consent.

By submitting content to Bowser (such as fuel price reports and reviews), you grant us a non-exclusive, royalty-free, worldwide licence to use, display and distribute that content within the Service for the purpose of operating and improving Bowser.

7. Limitation of Liability

To the maximum extent permitted by Australian law, including the Australian Consumer Law:

  • The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
  • We are not liable for any loss or damage arising from incorrect or outdated fuel pricing information.
  • We are not liable for any decisions you make based on information provided by the Service, including fuel purchasing decisions.
  • We are not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Service.
  • Our total liability to you for any claim arising from these Terms or your use of the Service is limited to the amount you have paid us (if any) in the 12 months preceding the claim.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee or right under the Australian Consumer Law that cannot be excluded, restricted or modified by agreement.

8. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms. Upon termination, your right to use the Service will immediately cease.

You may delete your account at any time through your account settings or by contacting us at support@bowser.au. Sections of these Terms that by their nature should survive termination (including Limitation of Liability, Intellectual Property and Governing Law) will remain in effect.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of Queensland, Australia. You agree to submit to the exclusive jurisdiction of the courts of Queensland for the resolution of any dispute arising from these Terms or your use of the Service.
